A Beaver County criminal defense attorney is facing charges of assaulting his wife a second time after authorities initially dropped the charges.
Police initially charged Gerald Benyo, 49 with aggravated assault after his wife Sharon told them her husband “beat her from head to toe” and hit her in the eye with a handgun on Oct. 26.
Ms. Benyo was arrested on Oct. 30 for failing to appear for a court hearing and that is when police noticed she had swollen eyes and a cut above her right eye, according to a criminal complaint.
She told police that her husband picked her up in Beaver Falls and after a brief argument Benyo assaulted her, struck her with the gun and then placed it underneath the seat of his car.
In two subsequent interviews Ms. Benyo told police she was unable to recall precisely where her husband picked her up and that he may have struck her with a closed fist and not a handgun.
Police alleged that Ms. Benyo said that because she was detoxing, she wasn’t sure her initial statement to them was accurate. She also said that the assault may have occurred on Oct. 27, as opposed to Oct. 26.
As a result of the changes in the woman’s account of the alleged assault police withdrew the initial charges and have now charged Mr. Benyo with two counts of simple assault and harassment.
Mr. Benyo has denied assaulting his wife.
A preliminary hearing in the case has been scheduled for Dec. 11.
